OK kids, I want to tell you what my mentor told me when I passed the bar. He said "Are you a lawyer now?".
To which I replied "Yes, I passed the Bar Exam".
He said "No you're not, you are just a member of the Bar. Call me after you have put a witness on the stand, after preparing him for testimony for weeks, and he testified just the opposite of what you expected, and on the spot you've had to adjust to that and try to put your case back together. Then you can call yourself a lawyer."
It happened about six years later.
So I say to your pals, happy to have all you unguided missiles join us to pay your dues, work for starvation wages all days and nights and weekends, whilst we take the bows and the money, but wait a while 'til you call yourselves "lawyers" and just stick to "Member of the Bar" for a while.

Nope, not slamming them, just giving them some honest reality check advice.
Anyone who survives the torture of a tough Bar exam is entitled to respect for their intellect and perseverence; law school is a arduous ordeal and six months or so of studying and relearning the material, then three days of testing and months of waiting for results are mind boggling.
But, having survived that experience often creates what I call unguided missiles, and the first few years can be painful experiences for young people who think they know it all, but get pantsed by old geezers who know all the tricks of the trade.
It is so painful that many leave the practice within five years of so to do something else with their education.
The practice of law is very competitive, and young lawyers need to understand that they are just beginning the process, not ending it by passing the Bar.
So I do congratulate and welcome all who have passed, but caution them to heed my words, as did I many years ago listen to my mentor.
I may be speaking at some of their swearing in's, seeing as Annie does attend a California School of Law and she was talking about the California Bar; I'll say the same thing there, if I do.

Comments Problems
i have been frustrated with the comments being down, too. For some reason, the whole of Munuviana has been hit hard recently. Pixy is on it, as he always is, but as you know he's only one man. Superhuman yes, but still only one man. Here's some interesting facts that might shed light on things or at least help us all to be patient:
We got 1.3 million trackbacks over the past 30 days, and 550,000 comments. About 99.8% of trackbacks and over 90% of comments were spam. Over 99% of the spam got blocked, but that still left a lot of cleaning up.

Massive amounts of comment spam coming in right now - several thousand a minute. Busy upgrading Fluffy's armament. Back soon.
Ugh. Seriously ugh. We're talking over a hundred comments a second here.
Update: New super doom-Fluffy installed. We'll see how we go with that.
Update update: 75,000 80,000 85,000 spams from a single source in under 90 minutes. It would have been more than that except that the server ground to a halt under the load. It's sped up significantly now that it's all being blocked immediately.
Update update update: Out of 90,000 95,000 spams, four actually got through. Congrats to Ted, Linda, Daniel and Lawren, who won the prize.
Update^4: 100,000! It's now 104 minutes since the flood started
Update^5: Looks like it's leveled off at a steady 1500 spams a minute. I wonder how long they'll keep up this futile exercise?
Update^6: Just past the two hour mark and it seems to have stopped. 123,111 spam attempts, four of which got through, for a success rate of 0.00324%. I shall now delete those four spams... And done.

We have to move off Movable Type; we have no choice in the matter. However, no-one will be forced off MT before they're ready. The new servers will be able to cope with the existing users just fine; the problem is that further growth will bring serious problems. We're already the largest MT installation in the world, and worse, we are stuck on version 2.6 due to licensing issues.

This is precisely the reason I moved platforms. When I realized that every morning I was waking up to stave off a new spam attack--and that if I
didn't do it, the spammers were able to take down the server
every morning--I realized that I simply couldn't stay with MT.
As much as I had enjoyed the ride, I hated having to spend so much time fighting the spammers.

I believe the tool shelly is referring to is called 'captcha,' where you have to type in a random combination of a word and numbers. I've heard other bloggers say it's highly effective; but I've only seen that on Expression Engine blogs...

Of course, pMachine and EE are from the same company. We use EE, and the captcha thing really does work. Comment spam went from ten or twenty a day to zero immediately. Then, the trackback spam started...

i know everybody's been pimping the
2002 Thomas Dalrymple article on the Parisian suburbs. i found it via
A Nation Of Riflemen. If you haven't yet read it, believe the hype. It's one of the most interesting things i've read all year.

Kevin says that there are constant police surveillance of the Muslim people. Every source I have read over the past few years says that there is no police presence in Muslim areas and that is one of the main reasons for the riots. The area has been in violent chaos for years.

Notice how concentrated the attacks are along the Riviera in Southern France. I have been there a number of times and I have rarely seen a Muslim there. The Al Qaida types must have moved a number of troops there with the purpose of scaring the hell out of the tourists and devastating the tourist industry.
I was in Nice last May (I had no choice). The hotels seemed empty. I talked to a hotel manager and he says the Americans are staying away. That was great news to me as it showed that our boycott of France is working.
Muslim attacks on resort towns combined with the ongoing American boycott could be a deathblow to thousands of hotels and cafes in France.

It's not my own claim; it's very likely something I translated from an article. In my translation of the Laurent Mucchielli interview, I did add the following note:
[NB: The sociologist is blaming the police, at least in part, for the electrocution deaths of the two youths. I disagree. While the sociologist may have a point about how a community might curdle under excessive police surveillance, we have yet to establish that the surveillance in the French banlieue has been excessive, given the banlieue's nasty, decades-old reputation. Perhaps it was the police's fault; perhaps it wasn't. I'd need to do more research before coming to my own conclusions.]
At this point, I have no clear impression as to how much or how little police surveillance there is in the banlieue, so I've made no claims about it.
If you read Dalrymple's article, you get the impression that the police dip into the banlieue only to knock heads on occasion; it is, otherwise, a lawless zone. If you believe Mucchielli, however, you get the impression that disaffected French youths are constantly on the run from the police, though it's not clear whether Mucchielli is referring only to the Paris banlieue, or to minority-heavy locales all over France.
I'm still forming impressions of the situation, so please offer me some interpretive charity, as the philosophers say. When I make some definite factual claims, I'll be sure to make them loudly. Heh.

Whenever Muslim youth leave the Muslim area and come into the "white" areas, they are under constant police surveillance. And from this surveillance, the conflict arises. Especially, since the youth control the streets in their own area.

Just because france did not want to go charging into George bush's persoanl war with no plan for re-construction hardly means the economy of the country should be targeted and several ordianry frenchies put out of business. This is just another example of bullying American foreign policy pursued by narrow-minded reactionary fools blinded by patriotism. If a country does not agree they must pay the price.

1. There is a real possibility that Saddam would not capitulate because he was confident that the countries he had bribed, France, Germany, Belgium and Canada would have stopped the US.
2. Saddam was selling a large quantity of oil to ELF, a French-government controlled oil company, for 30 cents a barrel. And ELF was reselling that oil for $30 a barrel. This in return for blocking UN action against Saddam.
3. Saddam had signed contracts with ELF that gave them exclusive right to Iraqi oil production. This would have made ELF one of the largest companies in the world. Those contracts would only take effect when France got the sanctions against Saddam lifted.
4. France was selling weapons to Saddam all during the boycott. Anti-aircraft missiles were found that had a ship date 3 months before the liberation of Iraq.
5. Many French government officials took bribes from Saddam to keep him in power.
6. French journalists took bribes from Saddam for favorable news articles.
7. France has practiced apartheid against their own Muslim citizens.
Anyone who believes that France should not be boycotted for these actions has no humanity.

Saddam went to the brink because he was sure that France and Russia would not let America attack him under any circumstances, a miscalculation that was well fed under the Clinton Administration.
I believe that if France and Russia (and Germany) had joined the coalition openly and early, we'd never have had to go there.
Saddam would have caved and allowed inspections and we'd still be playing cat and mouse with him, while he got even richer on the food for oil scheme.
Are we better off now or the other way? Sooner or later?
Me, I think we are going to prevail here and that hoistory will show that Bush was the one to stand againt radical Islamofascism.
He's still a hero to me.

When I saw Thailand on the prison list; I knew that the MSM had got the story wrong once again. There are a number of countries, Thailand is one of them, that are taking the offensive on Al Qaida. They are not pulling the covers over their faces like the wimpy europeans.
These countries are allowing the CIA to question their Al Qaida prisoners in their local prisons. This allows the CIA to piece together the world-wide operations of Al Qaida. This is important as an Al Qaida technique is to run a terrorist operation in one country from another.
MSM wants you to believe that we are in this terrorist war by ourselves. But there are 103 countries cooperating with us in killing or capturing Al Qaida. Almost all signed on after we liberated Iraq. They realized Bush was serious about going after Al Qaida. They knew Clinton wasn't.

I'm gratified that "...rough men stand ready in the night to visit violence on those who would do us harm." Clearly these fellows need to be kept somewhere, much as we kept the old Nazis, where they could do no harm, and where we might extract information. Torture? These people aren't sophisticates. You isolate them for a couple weeks. Wear them down mentally. Wire them for sound. Spike their OJ with some Everclear, and toss a compadre in their cell. You won't be able to shut them up.
On the other hand, I'm disappointed since this was my screenplay idea for season six of 24. Russian guards are the best. They're preconfigured for cruelty, work for vodka, and they don't like Moslims.

The Schizoid Man as the best episode? It's not bad, but there are several that are better--for instance, the ones with Leo McKern as Number 2 (
Chimes of Big Ben and the two penultimate episodes),

Many Happy Returns.

i like Chimes of Big Ben, and of course the obvious choices are the last two episodes, but Schizoid Man is all about an elaborate mind-fuck. They bring in another #6 to try and confuse our boy into thinking that he's not who he thinks he is. By the end of the episode even i get confused about who is who and what is what. It also contains a quote that i always think about when i'm at IHOP. "flapjacks are my favorite dish. flapjacks are my favorite dish."

Schizoid Man is also my favorite episode. I also like the finale. Talk about a mind-fuck! McGoohan had to go into hiding because people were so upset over it. My brother was an extra on the movie
A Time to Kill. He ate lunch with McGoohan one day. As they ate, my brother said to him, "My brother Chris has every episode of The Prisoner on tape. He recorded them from A&E. He's a big fan of your show." McGoohan, without looking up, said, "They're a strange lot, aren't they?"

Yep, that's a great story. I wonder what Mr. McGoohan referred to when he said "they" though? The episodes, or the fans?
And "Living In Harmony" is more of a mind-fuck, IMHO, for both the Prisoner *and* the viewer. Bet those folks who tuned in a bit late the first time it was ever broadcast were wondering, "WTF?"

A McGoohan or Prisoner haiku contest? Sure, I'm in. Last week I watched a tv reporterette explain a month-to-month median house price drop in San Diego County as something cyclical that happens EVERY year. Well, it hasn't happened for the last half-dozen. Should start to be a real buyers market in about a year or two.

Lying Is A Nasty Habit
One of the central characteristics of the left is the ease with which they lie. A website whose purpose is to direct trolls to right wing blogs had this to say about me:
Annika’s Journal - This lovely lady says Al Gore is “fat” and “tacky” Possibly her body is thin, but her brain spews nothing but vile bile. I’m confident that she is as tacky as it gets.
i once called Gore a "fashion disaster," but i never called him tacky. If you do a search using the search function at the bottom of my sidebar, you will easily find that the word "tacky" has never appeared on this blog before today.
Why lie, when the truth is so easy to find out? Because lefties know that most people won't go to the trouble to research things. This "tacky" lie is just a small example, but if you've been listening to the news lately you'll find many more examples of lefty lies that are much more disturbing.
It's also funny that my blog has been pigeonholed as a "right wing" blog. Sure i'm proudly conservative, but i don't blog about politics exclusively. Lately, i don't even think politics makes up half of what i write about. And how many right wing bloggers can say that they have turned over their blogs to left wing guest bloggers for a whole week, as i have. Twice.
You may also notice that it takes a heck of a lot for me to ban any troll, or to interfere in the comments section at all. Sometimes i think i should be more strict, but i truly believe in Ronald Reagan's precious ideal, "the marketplace of ideas." It's ironic that the one website which exhorts lefty trolls to go forth and comment, does not itself allow comments.
i like to think i do things differently here, but you wouldn't know it by reading what that lefty troll clearing-house blog says about me.

I'm not sure it's real productive, but I feel the need to point out that lying is not the exclusive province of the left. For example: President Bush went around for a long time talking about how he had said in a Chicago speech that he'd preserve the budget deficit except in case of war, recession or national emergency. He then joked that he never imagined he'd hit the trifecta.
It was a great laugh-line, and he repeated it for months, even after The New Republic, among others, had asked the White House to document the speech the President was quoting. They'd searched -- speeches of Presidential candidates are pretty well documented -- and came up empty. The White House press office never could find a specific citation. The President's story was, in a word, a lie.
It's not a big lie -- certainly not on the scale of condensing "fasion disaster" to "tacky"-- but it's the kind of thing that the President and his people do all the time.
The current administration's respect for the truth is exemplified by Condi Rice's explanation of the yellowcake uranium glitch in the SOU; she said it was "technically true," because the President hadn't said it was true, he'd said that the British said it was true.
Uh, OK, I guess. True, but hardly honest.
My point is that hyperbole and outright slander are not isolated on the left. You're more sensitized to bad behavior on the left because you're on the right. I'm on the left, and I just lived through an election where a war hero was smeared with charges that he had earned his decorations with self-inflicted wounds, and where self-declared patriots mocked wounds suffered in combat by decorating themselves with Purple Heart Band-Aids. You might remember that the right made a lot of money selling videotapes that accused President Clinton of Murder.
Empty invective is a hallmark of American politics these days. Everyone does it. The fact that you can only hear it coming from one side doesn't mean the other side isn't doing it. It just means you aren't an honest listener.

TOM, I will concede to you that there was a lot of Clinton hate, and some Kerry hate (not that he didn't deserve it after slamming combat vetrans before congress). But the Bush hatred is several orders of magnitude greater. And one thing that makes it worse is that back in the Clinton days, the people calling him a murderer and such were mostly talk show hosts and some fringe elements. Republican politicians critisised him but were much more circumspect.
But now, you have high ranking democrats including the head of the DNC accusing Bush of the most insane conspiracy crap. Also, at no time in the 200+ year history of our country has any other sitting President had his foriegn policy slammed by a former president, on foreign soil at that!
Its reprehensible.

Casca: We can debate Kerry's war record all we want, but one thing is undeniable. He volunteered twice for service in Vietnam. That's two times more than the combined total of President Bush, Vice President Cheney, John Ashcroft and Paul Wolfowitz.
One might imagine, as a patriot, that you would afford Senator Kerry the same respect you'd afford any combat veteran. But no: In the world where you, Casca, exist, patriotism and heroism are the sole property of Republicans. I give you as futher examples Max Cleland and the marvelous moment when Ollie North lectured Daniel Inouye, who lost an arm in World War II, on the nature of patriotic sacrifice.
As for Kyle, the main profiteer on the Clinton/Murderer front was Pat Robertson, who was at the time much more than a "fringe element" in the Republican Party.
You dismiss Clinton hatred as if it were some minor media fuss. Were you alive during the Clinton years? Do you remember Tom DeLay condemning Clinton on the floor of the house while American troops were in harm's way, saying that the only reason they were dying was to distract the country from the really, really important issue of Monica Lewinsky? Way to cheapen the sacrifice of the troops, Mr. DeLay!
You want 100 more examples? I'll give them to you. As a Christian and a family man, I can't turn on the TV at night without hearing how I'm against God (because I don't want prayer in schools) and anti-family (I don't believe reproductive decisions should be made by government) and unpatriotic (I think the President ought to get his facts straight before he drags us into a war -- a war which, by the way, I supported). I'm pretty familiar with the slurs of the right. I'm sure you're familiar with the slurs of the left.
I don't think it's productive to argue about which side is worse; they're both bad. Our political culture right now stinks. But for every Kos you revile, I'll give you one Little Green Footballs. We can pile up the list of offenses all night and accomplish absolutely nothing.
The point is that neither side is in a position to display the kind of no-self-awareness sanctimony in Annika's posting, blaming one side and one side only for something that is endemic and threatening to our political culture. It offended me when I first read it and it still does.
But somehow, lefty liar that I am, I've managed to get through this without callling anyone a "fucktard." Must have been some horrible oversight.

Your quoting yourelf as saying "fashion disaster" is deceptive. You said "What a fucking fashion disaster." I jumped off a descriptive cliff by using 'tacky' as a way of summing up words like "cheesy" and "fucking fashion disaster." a quasi-censorship program.
When a person visiting a blog clicks the "Flag?" button in the Blogger Navbar, it means they believe the content of the blog may be potentially offensive or illegal. We track the number of times a blog has been flagged as objectionable and use this information to determine what action is needed. This feature allows the blogging community as a whole to identify content they deem objectionable.
This disturbing development is totally separate from their policy regarding spam blogs. This is much more big brotherish.
Blogger excuses this quasi-censorship by referring to the "Wisdom of Crowds" concept. That's complete bullshit. They might have an argument if they gave readers the option to designate a blog as "unobjectionable." But even that would be problematic, because it's always more likely that a offended person would be motivated to click on a flag than someone who's not offended by content. You're going to see a situation where hypersensitive people or those with intolerant political viewpoints will have a kind of "hecklers veto" on blog content.
This is a bad idea, and totally goes against what i thought was Blogger's most important asset, the total freedom it gave to its users. It's also an unnecessary idea. Blog readers have always had a remedy for objectionable content they might happen upon. It's called the back button. Blogger's "Flag Button" is the blogging equivalent of yelling "Mom!" everytime your brother calls you a ninny.
If someone doesn't like what i write for instance, they can always leave a comment, or email me, and then never visit again. If i want to post a picture of my left tit, i'm glad i have the freedom to do so without becoming some kind of second class blog-citizen.

I guess it depends upon how Blogger uses its power...and how the flag is used. If Blogs For Bush or moveon.org orchestrates campaigns to flag blogs with particular political views, or if Hamas or Focus on the Family orchestrates campaigns to flag blogs with particular religious views, then hopefully Blogger will detect the scam and ignore it. However, if true grass roots flagging occurs (can true grass roots flagging be statistically identified?), then perhaps a few "induce sexually abused children to make nuclear bombs and target people of color" blogs will disappear.
I do wish, however, that the "Flag" button wasn't so prominent. In addition, the purpose is not intuitively apparent - if I hadn't read the fine print, I would have thought that "Flag" could be used to mark blogs that I *like*.

Anyone who watched the game KNOWS who dominated. If there was a Heisman player on the field, it was AJ Hawk. Vince Young got his ass beat, and the TD that kept them alive was the product of an officiating fraud call of non-existant pass interference. Texas benefited from bringing their officials all night.
All-in-all, Tressel's misplaced confidence in the choke-meister Justin Zwick fundimentally cost us the game.

Heisman, you want to talk Heisman? Go back to Strawberry Canyon on November 12 and you can see Heisman. Already one winner plus one nominee will be on the field that day; most likely two more future winners will be there as well. (Keep your eye on John David Booty)
As for the horsecock stuff, I guess you are starting to retrogress already, getting ready to take off your shirt and put on your blue paint. That sounds pretty sophomoric.
I was in Miami in January, watching all the Sooners and Boomers file out of the stadium starting at halftime; by the time the fourth quarter started, most were gone, looking for something to do in Miami that would give them relief from pain.
If I were a Bear, I'd be looking for something else to root for; Women's soccer and volleyball might be a good place to start.
As my eleven year old grandson would say "Trojans rule; Bears drool".

There is a fairly simple corrective measure, if you're a Blogspot blogger: turn off the nav bar in the template. Then there's no "Flag" button to press.

If the Bears, Irish, or the Bruins grow some gonads, you could see your beloved Trojans getting a good assfucking before they get to the Rose Bowl. We happen to have two extremely good QB's, but only one of them played Saturday, and only sporadicly.
I have no reason to believe that someone won't humble Texas before we reach December. An undefeated season requires more than weak sisters, it requires luck. Texas can't take their officials with them everywhere.
