4 Sorry Will, I am unable to cite authority, however it is common for the Justices to speak before various organizations and in my experience, whenever any Justice in a position such as Ginsburg, Stevens and Breyer (and O'Connor before she pulled the plug) do speak, there are always folks who speak with them after and urge them to remain on the court, etc. Add to this the internal pressure that is reflected in the fact that many Justices seem to leave when a President is in office who will seemingly appoint a like minded Justice to succeed them. While this is not always true, because Justices of the Supreme Court are very independent folks (we made them that way because of the lifetime tenure), nonetheless it seems to be the case more often than not. It seems clear enough to me, and many court watchers, that if either Stevens or Ginsburg, both of whom have health problems, are thinking of leaving, that they most likely will wait to see who the next President may be rather than give the seat to another Bush appointee. To do otherwise would, especially in the case of Justice Ginsburg, sorely disappoint those with whom she has socialized and worked with her entire life, all of the liberal, left side of the spectrum organizations such as the ACLU and others. For instance, were Stevens, who is 85 and not well, have to leave due to illness or death, don't you think the internal pressure on Ginsburg and Breyer to stay into the next Presidential term would mount even further?
